Daffodil Design Terms and Conditions
The following terms and conditions apply to all web site design
services offered by Daffodil Design. By ordering services from Daffodil
Design you are agreeing to the following terms and conditions, whether
or not the client has been provided with a copy.
Copyright
Alison Hanford, owner of Daffodil Design, owns the copyright and
trademarks of all content, materials, logos, certain design elements
and any other material from within the daffodil-design.com and daffodil-design.co.uk
domains and websites, unless otherwise stated, and may not be copied,
reproduced, rewritten, published or altered in any form without
written permission from Alison Hanford.
Our Terms of Use
You agree not to sell, license, rent, redistribute, retransmit,
modify, adapt, edit, alter or recreate any content in whole or in
part, of this site. However, you may print or download one copy
of the materials or content on this site on any single computer
for your personal, noncommercial use, provided you keep intact all
copyright and other proprietary notices. Any and all use of this
site whether in whole or in part, without written permission from
Alison Hanford is strictly prohibited. The Daffodil Design name,
logo and slogans are trademarks of Daffodil Design and are not to
be used in any way without written permission from Alison Hanford.
All other trade names used are the property of their respective
owners and have been used on this site with permission from their
respective owners.
Privacy Policy
Your information will never be sold or exchanged. This site does
not use cookies, however, we do monitor all IP addresses that access
and use this site for statistical information. This is used solely
for the purpose of analyzing site traffic, page hits and monitoring
user trends. Your IP address is never in anyway linked to your personal
identifiable information.
Designing Websites
We reserve the right to refuse to construct a web site which we
may judge as unfit due to content or otherwise. This includes, but
is not limited by, sites containing adult oriented material such
as pornography, sites which promote hatred towards persons belonging
to any ethnic group, religion or sexual orientation and sites which
infringe copyright or are contrary to UK laws.
The acceptance of a project shall be deemed as a contractual agreement
between the client and Daffodil Design. Daffodil Design cannot always
guarantee to start work immediately on a project but will arrange
a date with the client as to when work can commence.
It is the duty of the client to establish the rights to any material
supplied for inclusion on their pages. Daffodil Design cannot be
held responsible for any breach of copyright or any other right
caused by reproduction of materials supplied by the client.
The copyright for all material provided by Daffodil Design , such
as HTML code, graphics, photographs and text, will remain the property
of Daffodil Design until such time as payment has been made in full
whereupon they will become the property of the client. Any logo,
design, colours, etc. created by Daffodil Design, can only be used
on media and marketing, other than the website, by permission of
Daffodil Design, which, if not arranged prior to commission, may
incur additional costs.
Daffodil Design makes every effort to design pages which display
acceptably in the most popular current browsers, but cannot accept
responsibility for pages which do not display acceptably in new
versions of browsers released after pages have been designed.
Daffodil Design will submit a client's website to several of the
major search engines as part of the design package. Daffodil Design
will make every reasonable effort to design the website effectively
but cannot guarantee high placings in search engine results. Daffodil
Design can accept no responsibility or liability if any search engine,
online directory or search site, submitted to as part of basic search
engine optimisation, chooses not to list a client's web site.
Daffodil Design will initially place the client's website on temporary
web space during building, in order that the client may view and
comment upon the website's progress. When both Daffodil Design and
the client agree that the website meets the criteria agreed during
the web design process, Daffodil Design will invoice the client
for the full amount due for the project, or if the client chooses
the monthly payment plan payment option, Daffodil Design will invoice
the client for the first monthly payment. When this invoice has
been settled, the website will be uploaded to permanent hosting.
Should the client wish to host the website on their own choice of
server, Daffodil Design will publish the website on the client's
server, or provide the source code for the site via email (or cd-rom
disk for an additional £10 fee) for the client to upload,
only once full payment has been received.
Payment
Daffodil Design expects payment by cheque, credit or debit card
via Paypal or Nochex or cash within 14 days of the date on the invoice.
In the event of a dispute regarding the design of the website
or withheld or late payment Daffodil Design reserves the right to
withhold or withdraw all web pages and image files until such dispute
is resolved. If an invoice is overdue by 28 days or more, we shall
automatically suspend the website and a charge shall be made for
it to be reinstated. We will then instruct our solicitor to begin
the recovery procedure.
Any payment returned by the bank or credit card company will incur
a £25 administration charge. This will be invoiced and will
be added to the total outstanding debt owed by the customer.
Maintenance
Daffodil Design undertakes to maintain or update a client's website
content as part of our brochure style design package for a period
of 12 months. Website redesign work will be charged in addition
to the package price and is not included with the package free content
updates.
If a client wishes Daffodil Design to maintain or update a website
content as a separate commission after this time, Daffodil Design
will negotiate with the client a maintenance contract on a time
or per job basis.
Our maintenance offer that applies to the above web design packages,
can be stopped at any time by us (when there is a good reason).
We cannot guarantee when updates for these packages will be carried
out, although we will make every effort that these are done as quickly
as possible and usually within 24 - 48 hours.
Cancellation
If at any point during the development phase a client wishes to
cancel, they may do so but will be invoiced an amount that Daffodil
Design judges to be proportional to the amount of work completed
on the project. If, during the development phase, the client does
not supply the content required in order to complete the commission
within a reasonable amount of time, Daffodil Design will consider
that the client wishes to cancel the commission.
If, after a website has been published, the client wishes to cancel
their contract with Daffodil Design, they may do so immediately
providing that the initial 12 month web design package has been
paid in full. If the client wishes to cancel part way through the
first 12 months of the package and has chosen the monthly payment
plan payment option, the client will be invoiced the total for the
remainder of the package. When this invoice has been settled, the
contract will be terminated.
All basic hosting accounts are charged 12 months in advance and will
not be refunded upon cancellation of an account.
All monthly ecommerce hosting accounts are charged in advance and
may be cancelled by the client with notice before the next billing
period (1st of the month). If a client wishes to cancel part way through
the month, the costs for that month must still be paid.
Daffodil Design reserves the right to terminate all hosting accounts
with 21 days advanced notice. It is the responsibility of the client
to download all files and emails. Any files left on the server after
this period will be deleted.
Maintenance agreements are offered at special rates and upon cancellation,
with good reason, all work already carried out will be charged at
full rate and any monies in excess of this amount may be refunded
to the client at our discression. This is assessed on an individual
client basis.
Changes
Daffodil Design reserves the right to alter prices at any time
without notice. If a client has commissioned any services from Daffodil
Design prior to a change in prices, that commission will not be
subject to any increase, but any subsequent commission may be subject
to an increase.
Hosting
Daffodil Design uses a third party web hosting company and cannot
be held responsible for:
- Any extra hosting costs incurred by the client through changes
which may require additional web server facilities;
- Any delays to the launch of the site caused by the web hosting
company;
- The site being offline due to problems with the server.
Clients shall be responsible for insuring themselves against any
loss or damage to data. In no event will Daffodil Design be liable
for loss or damage to the data stored, transmitted on or using the
service.
Daffodil Design reserves the right to terminate all hosting accounts
with 21 days advanced notice. It is the responsibility of the client
to download all files and emails. Any files left on the server after
this period will be deleted.
By agreeing to these terms and conditions your statutory rights
are not affected.
Daffodil Design reserves the right to change or modify any of
the terms and conditions contained in the Terms and Conditions.
